4 No Guarantee of Outcome

WinMyAppeals makes no representation, warranty, or guarantee that use of our appeal letters will result in:

  • The reversal of any insurance denial
  • Approval of any insurance claim
  • Payment of any medical benefit
  • Any specific result in an administrative or legal proceeding

The outcome of any insurance appeal depends on many factors outside our control, including but not limited to: the specific facts of your case, your insurance policy terms and conditions, applicable state or provincial law, and the discretion of your insurance company's review process.

Our "unlimited appeals" commitment refers to the preparation of as many appeal letters as you need at no additional charge. It is not a guarantee of approval, payment, or any specific outcome.

5 Your Responsibility for Deadlines & Requirements

Insurance appeal deadlines, procedures, and requirements vary significantly by:

  • Insurance company and plan type
  • U.S. state or Canadian province
  • Whether coverage is through an employer, marketplace, government program, or private insurer
  • The nature and category of the denial

You are solely responsible for:

  • Understanding and complying with your specific plan's appeal procedures
  • Meeting all deadlines for filing appeals — which may be as short as 30 days from the date of denial
  • Submitting required documentation as specified by your insurer
  • Following up with your insurance company directly
  • Verifying that the letter content is appropriate for your specific situation before submitting it

WinMyAppeals is not responsible for any missed deadlines, procedural errors, or consequences arising from your appeal submission or failure to submit.

6 Not a HIPAA Covered Entity

WinMyAppeals is not a "covered entity" under the United States Health Insurance Portability and Accountability Act (HIPAA). As a document preparation technology company, we do not bill for healthcare services, transmit protected health information to insurance companies on your behalf, or operate as a healthcare provider.

However, we take the security and privacy of your health-related information very seriously. We employ industry-standard 256-bit SSL encryption to protect information transmitted to and from our platform, and we implement reasonable security measures to protect information stored on our systems.

By providing health-related information and plan documents to WinMyAppeals, you consent to our use and storage of that information for the purpose of providing the membership: reading your plan, generating your reports, and preparing your appeal letters. We do not sell or share your health information with third parties. You can delete it all at any time from your Account page.

7 Canadian Privacy Law (PIPEDA)

WinMyAppeals is operated from Canada and aims to operate in compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA), Canada's federal private-sector privacy law.

Under PIPEDA, any personal information, including health-related information, that you provide to us is:

  • Collected only with your knowledge and consent
  • Used only to provide the membership service described in our Privacy Policy
  • Not disclosed to third parties without your consent, except as required by law
  • Retained while your account is active and deleted when you delete your account
